State v. Maria L. (Neb. June 26, 2009)

Last updated:

In the case of _State of Nebraska v. Maria L._, the defendant (Maria L) was a Quiche-speaking, undocumented Guatemalan immigrant who had her parental rights revoked after a language barrier caused her to miss a medical visit. Lower courts ruled in favour of the State, terminating Maria’s parental rights and deporting her to Guatemala. However, the Supreme Court unanimously overturned this decision, affirming that undocumented, detained, and deported immigrant parents have a constitutionally protected right to the care, custody, and control of their children.
