NIWAP Inc. led national amicus brief that provided legislative history of the VAWA confidentiality provisions and the U visa and discussed the public policy effects on victims of domestic violence, sexual assault, human trafficking and other crimes if discovery of VAWA confidentiality protected information is allowed from either the EEOC or the individual victim workers in civil employment discrimination cases brought by the EEOC on behalf of victims of sexual and physical assault in the work place. The appeal led to a reversal, confirmation that VAWA confidentiality protected information is not discoverable from the EEOC and provided direction to the District Court to be used in conducting a balancing of interests test under federal rule of civil procedure 26 (5th Cir. Sep. 27, 2016).
