NIWAP, Legal Momentum, and the Tahirih Justice Center with the assistance of Haynes Boone submitted an amicus brief urging the Third Circuit to reverse the denial of VAWA cancellation of removal protections to Samuel Cardenas, arguing that VAWA covers abused immigrant children and stepchildren regardless whether the abuse was still occurring at the time of filing and without regard to when the abuse obtained lawful permanent residence. The Board of Immigration Appeals misapplied the law.
