In the case of Am. Online Dating Assn v. Gonzales, plaintiffs requested a temporary restraining order prohibiting enforcement of some sections of the International Marriage Brokers Regulation Act of 2005 alleging violations of the First and Fifth Amendments. The court denied the temporary restraining order, finding that the law did not prohibit speech, did not concern a fundamental liberty interest, did not deny the person’s right to marry, and that no suspect classification was implicated for equal protection purposes. (S.D. Ohio May 25, 2006).
